GENERAL TERMS AND CONDITIONS
for online trade with consumers as of June 2020
1. IDENTITY OF THE CONTRACTING PARTY AND CHOICE OF LAW

German law shall apply with the restriction that consumers with a habitual residence abroad may invoke the mandatory consumer protection provisions of their home country irrespective of this choice of law.
2. CONCLUSION OF THE CONTRACT, CONTRACT LANGUAGE, ORDERS
(1) Contracts can be concluded on this portal by customers residing in the EU and in Norway, Liechtenstein and Switzerland.
(2) Contracts can only be concluded in German.
(3) The ordering process comprises the following steps, whereby you will be automatically guided through the ordering process:
First select the desired goods and place them in the shopping cart. In the second step, you can then initiate the receipt of payment by activating the "Checkout" field. You then have the option of processing the order and payment via Express Checkout using Visa, Mastercard, American Express, Apple Pay, Google Pay, Klarna, Maestro, Union Pay and PayPal or alternatively by entering your email and delivery address. You can then give your consent for us to save the information you have previously entered by checking a box provided for this purpose so that you can pay more quickly next time. You will then activate your preferred payment method and enter the necessary data (e.g. credit card details). If the delivery address is not also to be used as the billing address, you can (deactivate) the corresponding box and enter the data for the billing address in the input fields that then appear. Regardless of whether you enter a separate billing address or not, an overview of the items you have ordered and the shipping costs (if applicable) will appear. You can then check your order in the next step. By activating the "Check order" button, you will be taken to the page with an overview of the goods ordered and the other data you entered in the previous steps. You have the option of correcting your entries by clicking on "Change" before you can send the chargeable order by activating the "Buy" field after confirming the General Terms and Conditions and the right of withdrawal. You will then receive an order confirmation to the e-mail address you have provided, which is also the order confirmation. Attached to this e-mail are our General Terms and Conditions as well as our revocation instructions and the revocation form.
(4) The presentation of the goods does not constitute a binding offer. The contract is concluded when the order button is activated, at the latest when payment is made using the payment methods offered.
3. STORAGE OF THE CONTRACT TEXT
Keralit GmbH stores the contract text of your order. You will receive - as already described above - an order confirmation with all order data to the e-mail address you have provided immediately after placing your order.
4. RETENTION OF TITLE
(1) The delivered goods (reserved goods) shall remain the property of Keralit GmbH until full payment of all claims arising from this contract.
(2) In the event of seizure of the reserved goods by third parties or other interventions by third parties, you must point out the ownership of Keralit GmbH and must inform Keralit GmbH immediately in text form so that Keralit GmbH can enforce its ownership rights.
5. PRICES, SHIPPING COSTS
1) All prices are total prices and include statutory VAT.
(2) The amount of the shipping costs incurred as well as the free shipping limit for the individual countries can be found in the cost overview in our current delivery and shipping conditions.
(3) The shipping costs are calculated and shown in the shopping cart before an online order is placed and are shown separately in the overview and on the invoice.
6. ACCEPTED MEANS OF PAYMENT, INVOICING
(1) We accept the following means of payment:
Visa, Mastercard, American Express, Apple Pay, Google Pay, Klarna, Maestro, Union Pay, PayPal
(2) Keralit GmbH is entitled - subject to conflicting statutory provisions of the respective country in which you are resident - to invoice the services provided electronically. If Keralit GmbH makes use of this right, you will receive the invoice by e-mail. You can revoke your consent to this if there are objectively important reasons for not sending the invoice by e-mail. This revocation must be declared in text form, stating the reason.
7. TERMS OF DELIVERY, DELIVERY DURATION
(1) You will receive a shipping confirmation in good time with the shipment.
(2) Delivery shall be made by parcel service on working days only.
(3) The delivery period is calculated as follows: The period for delivery shall begin on the day after the payment order is issued to the payment service provider. If the last day of the period falls on a Saturday, Sunday or a public holiday recognized by the state at the place of delivery, the following working day shall take the place of such a day.
8. INVOICING, RIGHT OF RETENTION
(1) You shall only be entitled to set-off if your counterclaims have been legally established by a court or are undisputed. This restriction does not apply to counterclaims arising from the same contractual relationship.
(2) You may only exercise a right of retention if the claims result from the same contractual relationship.
9. RIGHT OF REVOCATION
Consumers have the in our Cancellation policy described in our withdrawal policy. A consumer is any natural person who enters into a legal transaction for purposes that are predominantly outside his or her trade, business or profession.
10. LIABILITY FOR DEFECTS
(1) The statutory liability for defects shall apply. The provisions of the national law applicable to the consumer shall apply.
(2) For all defects of the purchased item occurring during the statutory warranty period of 2 years, the statutory claims shall apply at your discretion. Subject to other national statutory provisions, the warranty period shall commence upon receipt of the goods.
11 LIABILITY
(1) Keralit GmbH shall not be liable for damage to property or financial loss caused by slight negligence. This shall not apply in the event of a breach of an obligation which makes the proper performance of the contract possible in the first place and on the observance of which the Customer can regularly rely. In the aforementioned cases, the liability of Keralit GmbH for damage to property or financial loss caused by slight negligence shall be limited to the foreseeable damage typical for the contract. The same shall apply to the fulfillment of obligations by vicarious agents of Keralit GmbH.
(2) The aforementioned limitation of liability shall not apply in the event of injury to life, limb or health.

13. ONLINE DISPUTE RESOLUTION:
If we are unable to resolve a dispute with you regarding a contract concluded with us, you can contact the arbitration body responsible for us, which is named in more detail below.
